Nakazaki comentó además que urge establecer las reglas para la figura legal del feminicidio.

En torno a los recientes casos de ataque con fuego a mujeres, el abogado César Nakazaki manifestó que existe una muy mala aplicación de la ley de la tentativa, por el cual no se está procesando debidamente a los atacantes.
 
“Se convierte a una mujer en una pira humana y, sin embargo, como no muere en ese momento, no se le procesa por delito consumado, sea de homicidio calificado o feminicidio, y se le condena por tentativa. Como no te mueres en el momento y te mueres 8 días después, es tentativa y no es delito consumado”, argumentó el penalista.
 
Nakazaki explicó también que al tratar el caso como una tentativa circunstancia atenuante de la pena privilegiada, la pena que se impone termina siendo por debajo del mínimo legal. En otras palabras, si la pena es de 15 a 35 años, debe reducirse a 14 años para abajo.
 
“Esa es una mala comprensión de la tentativa. La tentativa se produce cuando el delincuente intenta cometer el delito y el resultado no se produce por una causa o razón ajena a su voluntad, pero si yo incendio a una mujer y días después muere como consecuencia de mi acción, eso obviamente no es una tentativa, es un delito consumado”, destacó.
 
Por otro lado, el abogado exhortó a la Corte Suprema a establecer las reglas para la figura legal del feminicidio, que supone matar a una mujer por el simple hecho de ser mujer. De acuerdo a Nakazaki, la razón básica de este tipo de violencia, el ser mujer, es de problemática aplicación y comprensión, por lo que es necesario lograr acuerdos que permitan poner adecuadamente en práctica esta figura.
