CASO PPK: POR LEY SOLO EL FISCAL DE LA NACIÓN Y LA CORTE SUPREMA PUEDEN INVESTIGAR A UN EXPRESIDENTE

El abogado César Nakazaki explicó que en la investigación que se sigue al expresidente Pedro Pablo Kuczynski por presuntos delitos, no están interviniendo fiscales habilitados por la ley, ni un juez competente.

El abogado César Nakazaki comentó que la primera regla para que las decisiones que se toman en los casos penales tengan un valor constitucional es que se cuente con un fiscal habilitado por la ley y un juez competente, condiciones que no se cumplen en la investigación que se sigue al expresidente Pedro Pablo Kuczynski.
 
El penalista reveló que el artículo 99 de la constitución y las leyes especiales en la materia se puede encontrar que no es un fiscal provincial, que es la categoría del fiscal Hamilton Castro, el que puede investigar a personas protegidas por el escudo de la inmunidad, que se alcanza mientras se ejerce el cargo y se extiende hasta 5 años después de haberlo dejado.
 
“Solamente lo puede investigar el Fiscal de la Nación y solamente puede conocer el proceso la Corte Suprema de Justicia. Eso es lo que en los próximos días vamos a desarrollar con intensidad como actos de defensa para partir de una investigación cuyo resultado tenga valor”, comentó Nakazaki.
 
En este sentido, afirmó que tanto el caso lava jato, como el impedimento de salida, los allanamientos, las incautaciones y las diligencias que se vienen realizando están “heridas mortalmente de nulidad”. “Lo vamos a corregir, no para que el caso acabe, sino para reconducir el caso al árbitro que corresponde y jugar un partido que tenga valor”, sentenció.
