Respecto a la investigación que se sigue al expresidente Pedro Pablo Kuczynski, el abogado César Nakazaki resaltó que es absolutamente inconstitucional que el Congreso investigue los presuntos delitos de la misma forma que el Ministerio Público, pues se incurre en una doble investigación.

Ante la intención de la Comisión Lava Jato de investigar al expresidente Pedro Pablo Kuczynski por presuntos delitos, el abogado César Nakazaki explicó que, de acuerdo al artículo 159 de la Constitución, únicamente el Ministerio Público tiene la facultad de investigar los delitos.
 
El penalista agregó que de acuerdo a la carta magna y al propio reglamento del Congreso de la República, este solo debe investigar temas de interés público para proponer cambios legislativos que permitan subsanar errores, pero no hacer una persecución penal a las personas.
 
En este sentido, indicó que la investigación que pretende seguir la Comisión Lava Jato al expresidente Kuczynski no se ajusta a la norma y, sumada al proceso del Ministerio Público, genera una doble investigación. “Eso es absolutamente inconstitucional, porque se llama prohibición de doble persecución múltiple o simultánea”, sentenció Nakazaki.
