CASO KENJI: CONGRESO Y MINISTERIO PÚBLICO EN CONTRADICCIONES POR MAMANI-VIDEOS

César Nakazaki aseguró que mientras el Ministerio Público ha establecido que los Mamani-videos no se pueden utilizar como pruebas por estar editados, el Congreso, en su antejuicio, indica que estos sí constituyen una prueba adecuada para levantar la inmunidad parlamentaria y ordenar un proceso penal contra Kenji Fujirmori.

En relación al proceso de desafuero que se sigue contra el congresista Kenji Fujimori, el abogado César Nakazaki explicó los motivos que han llevado a que en este caso existan contradicciones entre el Congreso y el Ministerio Público.
 
En este sentido, aseguró que, cuando se cree que un congresista ha cometido un delito, por reglamento, el Congreso de la República debe seguir solamente uno de los siguientes caminos:
  1. Pedir la investigación preliminar del Fiscal de la Nación para que determine mediante una denuncia constitucional si debe iniciarse un antejuicio, que supone la autorización para abrir un proceso penal contra un congresista.
  2. Hacer directamente un antejuicio al tener un caso claro y autorizar al fiscal para que abra el proceso penal contra el congresista sin ningún tipo de investigación.
No obstante, el penalista explicó que el Congreso, además de pedir una denuncia al Ministerio Público apenas salieron los Mamani-vidos, empezó a realizar en paralelo un antejuicio, sin esperar las investigaciones del fiscal.
 
Según Nakazaki, esta situación ha generado contradicciones, ya que por un lado el Ministerio Público ha determinado que los Mamani-videos no pueden considerarse como pruebas al haber sido editados, mientras que el Congreso, en su antejuicio, ha establecido que sí son prueba suficiente para acusar constitucionalmente al congresista Kenji Fujimori, levantar la inmunidad y ordenar un proceso penal.
 
“¿Para qué se utilizaron los dos caminos a la vez? El reglamento del Congreso dice que optes por uno u otro. Lo correcto era que el Congreso espere que el Fiscal de la Nación acabe su investigación, no hacer otro caso en paralelo y generar esta colisión que ya viene haciendo mucho daño”, sentenció el abogado.
