Defensa del exmandatario manifestó su extrañeza con respecto a que la parte civil no acepte la posición de la CIDH.
La Sala Penal Especial de la Corte Suprema de Justicia evaluó la apelación presentada contra la resolución que anuló el indulto a favor del expresidente Alberto Fujimori.
Sin embargo, la misma fue dejada a votación. Al respecto, César Nakazaki, defensa del exmandatario se pronunció y manifestó su extrañeza con respecto a que la parte civil no acepte la posición de la CIDH.
“La Corte Interamericana claramente establece que en el derecho peruano la única vía en la cual se puede dejar sin efecto un indulto es el amparo y las víctimas aceptan ante la misma Corte esa situación”, precisó.
Asimismo, no dejó en mostrar su incomodidad por la falta de apoyo de las autoridades para defender el indulto de su patrocinado. “Ante la Corte Interamericana el Estado entregó todos sus documentos que demostraban que el indulto a Fujimori fue absolutamente regular, pero como ahora hay otro presidente de la República y hay otro ministro de Justicia, se ocultan los documentos que el mismo Estado Peruano presentó ante la Corte para defender el indulto”, aseguró.
Por otro lado, Carlos Rivera, abogado de los deudos de las víctimas de los casos de Barrios Altos y La Cantuta, espera que el fallo salga a favor de sus defendidos.
“Nosotros tenemos esa seguridad en el sentido que ha sido convalidada la competencia del juez, han sido acreditadas las graves irregularidades que justamente lo que motivó la acción legal que nosotros iniciamos en diciembre del año pasado”, señaló.
Como se recuerda, tras darse a conocer la anulación de su indulto, el expresidente Alberto Fujimori, se encuentra internado en la clínica Centenario, ubicado en Pueblo Libre, y donde según su abogado, él solo saldrá cuando los médicos consideren que su salud es estable.
