Para el abogado del empresario y dirigente deportivo, la decisión del juez de Chiclayo de dictar 18 meses de prisión preventiva se debe a la detención preliminar que se le dictó en Lima por otro caso de mayor dimensión.
El abogado César Nakazaki, defensor legal del empresario y dirigente deportivo Edwin Oviedo en el caso 'Los wachiturros de Tumán', cuestionó que el fiscal a cargo de este caso haya solicitado prisión preventiva -pedido que fue aceptado- pese a que se acusa a su patrocinado desde hace varios años sin que haya sido llevado a juicio.
"Las acusaciones ya tienen varios años y en vez de haberlo llevado preso, lo que han debido generar es ir a juicio para de una vez definir si es inocente o culpable. Cuando una persona es llevada a juicio y el fiscal se demora años en llevar a juicio, no puede pedir prisión preventiva", señaló", manifestó en diálogo con RPP Noticias.
Nakazaki, quien llegó hasta Chiclayo para participar este jueves en la audiencia de apelación a los 18 meses de prisión preventiva impuestos contra Oviedo por este caso, consideró que esta medida responde a un "efecto contagio" provocado por la detención preliminar dictada por el caso 'Los Cuellos Blancos del Puerto'.
"La prisión preventiva se ha dictado por un efecto contagio. Todos los procesados en el caso 'Los wachiturros de Tumán' está libres, los autores materiales que se les imputa haber matado están libres. Lo que sucede es que como días antes que se resuelva la prisión preventiva le dieron la detención preliminar en Lima y se produce lo que yo llamo 'efecto contagio': apestado en Lima, apestado en Chiclayo; preso en Lima, preso en Chiclayo", señaló.
En ese sentido, y bajo esta misma lógica, Nakazaki adelantó que intentará demostrar que si las autoridades judiciales no encontraron motivos para que esté preso por un caso más grande como el de 'Los Cuellos Blancos del Puerto', "con mucha razón acá" (caso Wachiturros).
"Así como en Lima hemos demostrado que no se justificaba la prisión preventiva de Edwin Oviedo en el caso de 'Los Cuellos Blancos del Puerto', esperamos mañana poder demostrar que tampoco se justifica una prisión preventiva en este caso", manifestó.
