CASO PPK: "CONGRESO SOLO PUEDE INVESTIGAR PERSONAS EN ANTEJUICIOS Y JUICIOS POLÍTICOS"

En entrevista a RPP, el abogado César Nakazaki afirmó que el trabajo de las comisiones investigadoras del Congreso, como en el caso de la comisión Lava Jato, resulta ser una preinvestigación a la investigación oficial, pues finalmente su informe es entregado a la Fiscalía para que evalúe si lo tomará en cuenta como un elemento de juicio adicional.

El abogado César Nakazaki comentó en una entrevista concedida para RPP que, durante su mandato, el expresidente Pedro Pablo Kuczynski contribuyó como testigo brindando información a la comisión Lava Jato, sin embargo, ahora en calidad de ciudadano investigado por la presunta comisión de delitos, la Constitución establece que la investigación corresponde al Ministerio Público y no al Congreso de la República, de lo contrario se incurriría en una doble defensa.
 
“De acuerdo a la Constitución se prohíbe que a un ser humano se le someta a una doble investigación penal; ese es un principio universal”, resaltó el penalista. Asimismo, reveló que los informes de las comisiones investigadoras del Parlamento son entregados a la Fiscalía para qu​e​ evalúe si serán tomadas en cuenta como elementos de juicio adicionales en la investigación oficial, por lo que el trabajo de estas comisiones se configuraría como una preinvestigación.
 
“Desde la primera vez que me tocó intervenir en este tipo de procesos durante el Congreso del régimen de Alejandro Toledo siempre sostuve que este tipo de investigaciones solo sirve es para 2 cosas: descabezar a enemigos políticos y mantener reflectores”, afirmó Nakazaki. “El problema es que el Congreso se ha acostumbrado a investigar delitos. Es un problema estructural”, sentenció.
