Abogado del expresidente y su esposa explicó que las comisiones parlamentarias investigan temas de interés público
El abogado penalista César Nakazasi, defensor legal del expresidente Ollanta Humala y su esposa Nadine Heredia, se mostró en contra de que la Comisión de Fiscalización investigue la muerte de Emerson Fasabi. El letrado dijo esto al recordar que las comisiones del Congreso investigan temas de interés público y no homicidios comunes.
"El Congreso solo puede investigar personas si hay antejuicio. O sea, si son altos funcionarios públicos. Pero investigar homicidios comunes como sería el caso Fasabi, eso lo tiene que investigar la Fiscalía. El Congreso, las comisiones investigadoras, investigan temas de interés público, no personas y posibles responsabilidades penales", señaló.
El letrado consideró que desde hace varios años las comisiones fiscalizadoras cometen "un abuso" porque "una doble investigación viola un derecho fundamental que es la prohibición a la doble persecución". En su opinión, los grupos parlamentarios deben investigar temas de interés públicos en antejuicios y juicios políticos.
"La Constitución establece que si hay delitos comunes, investiga el Ministerio Público; y si hay delitos cometidos por altos funcionarios públicos, en primera instancia investiga el Congreso, pero no vía una investigación parlamentaria sino el proceso constitucional del antejuicio", aclaró.
En ese sentido, calificó que la decisión de Humala de no recibir a la Comisión de Fiscalización responde a una protesta por lo que considera un injusto encarcelamiento. Asimismo, negó que Nadine Heredia haya tenido una actitud obstruccionista, tal como dijeron representantes de este grupo de trabajo.
