El penalista César Nakazaki sostuvo que la resolución de la Corte IDH, para archivar la acusación contra los magistrados del Tribunal Constitucional dentro del proceso de supervisión de sentencia por el caso El Frontón, es una medida cautelar que tiene serios problemas. Por lo tanto, el Estado peruano tendría la opción de decidir si cumple o no con la medida adoptada por este organismo supranacional.
Para Nakazaki, es necesario que en el caso El Frontón se aseguren las garantías para los agraviados y acusados como parte del debido proceso. Además, indicó que la decisión de la corte es para complementar la justicia peruana y no para reemplazarla.
