La justicia mediática atenta contra la independencia judicial

Nakazaki aseguró que el principal problema de la administración de justicia es la falta de independencia judicial, que significa aplicar la ley sin presiones.

El abogado César Nakazaki cuestionó las severas críticas que realizó Panorama el pasado domingo 01 de julio contra los jueces superiores de una de las salas de apelaciones de la Sala Nacional, asegurando que solo se reducen a que los jueces resolvieron a favor de los procesados, sin detenerse a analizan el tema central: la ley se aplicó correctamente.

“¿Existe el derecho de crítica a la resolución judicial? Por supuesto, es un derecho constitucional, pero se tiene que hacer de manera responsable. ¿Cuándo se critica al juez? Cuando viola la ley o incurre en error judicial, en arbitrariedad. Pero cómo criticar al juez y hacerle creer a la opinión pública que es malo si aplica correctamente la ley, que es la misión que se le ha dado”, señaló el penalista.

El abogado explicó que el principal problema de la administración de justicia no es la corrupción, porque no todos son corruptos ni son corruptores, sino la falta de independencia judicial. “Cuando un juez quiere ser independiente, que significa aplicar la ley sin presiones, aparece la justicia mediática para hacerle creer a la gente que el buen juez es el que resuelve con el aplauso de la tribuna. Pero qué pasa si la tribuna no está en lo correcto”, apuntó.

En este sentido, Nakazaki comentó que los jueces no deben resolver en función a la búsqueda de popularidad, sino exclusivamente a hacer justicia aplicando la ley. Asimismo, manifestó que el reportaje de Panorama supone un atentado contra la independencia judicial, porque “ninguna de las resoluciones judiciales que motivaron la crítica que hizo el programa generó error judicial”.

“Al juez se le juzga por la forma cómo utiliza el derecho, no porque el sentido de la resolución le gusta o no le gusta a la gente. Eso no es crítica a la resolución judicial, es un atentado a la independencia judicial y eso hace que el juez sea cobarde al momento de aplicar la ley. Y cuando eso sucede, producto de la presión, la justicia desaparece” sentenció.
