Nakazaki comentó que el efecto retroactivo de la inmunidad parlamentaria protege la función de los Congresistas de persecuciones penales injustificadas.
En relación a los dos Congresistas procesados penalmente por hechos delictivos anteriores a asumir el cargo y las discusiones sobre si es correcto o no pedir el levantamiento de la inmunidad parlamentaria para ejecutar las sentencias condenatorias, el abogado César Nakazaki reflexionó sobre la correcta aplicación del efecto retroactivo que tiene el privilegio de la inmunidad.
Según el penalista, el Tribunal Constitucional reconoce la inmunidad y su efecto retroactivo siempre y cuando no haya existido un proceso por el hecho delictivo anterior en el cual se involucra al Congresista; por otro lado, si durante la función parlamentaria sí preexistían casos penales abiertos, ya no aplica la retroactividad de la inmunidad, evitando de esta manera que se asuma este cargo público con propósitos de impunidad.
Finalmente, Nakazaki agregó que la inmunidad permite que el Congreso funcione con el quórum necesario, pues lo protege de un posible desmembramiento por persecuciones penales injustificadas que respondan a fines políticos.
