Juicio político: “Inhabilitaciones que da el Congreso son inconstitucionales y podrán ser anuladas”

Nakazaki sostuvo que el Congreso debe resolver el destino del Fiscal de la Nación mediante un antejuicio, en lugar de un juicio político.

El abogado César Nakazaki expresó su preocupación por un grave problema que viene presentándose en el procedimiento parlamentario del juicio político, explicando que hasta el momento el Congreso no ha tipificado en qué consisten las infracciones constitucionales, figura que ha venido siendo utilizada para inhabilitar a funcionarios públicos.
 
“¿Son dolosas o culposas? ¿Son comisivas u omisivas? ¿Solo admiten autor o también tienen partícipes? ¿Qué infracción constitucional corresponde a cada año de inhabilitación? Eso no está desarrollado en una ley y, mientras eso suceda, el principio de legalidad dice que no puede funcionar el juicio político”, apuntó el penalista.
 
En este sentido, reveló que todas las inhabilitaciones que viene dando el Congreso vía juicio político son inconstitucionales y, en su momento, podrán ser anuladas. Nakazaki advirtió que este podría ser el caso del Fiscal de la Nación.
 
“En el caso del Fiscal de la Nación, si se le va a atribuir, no delitos, sino infracciones constitucionales, no tiene sentido por lo que estoy explicando. El destino del Fiscal de la Nación, si tuviese que ser resuelto en el Congreso, tendría ser resuelto no por juicio político, sino por antejuicio (delitos de función)”, sentenció.
