Nakazaki comentó que el Fiscal Chávarry mostró una conducta que podría calificarse como mentira.

El abogado César Nakazaki aseguró que hay información por la que se puede establecer que el Fiscal Chávarry mintió respecto a su vínculo con el juez César Hinostroza, como lo demostraron los audios difundidos anteriormente, sin embargo, sostuvo que en dichos audios no se puede establecer que exista algún delito.
 
“En esos audios no se evidencia un delito de cohecho, tráfico de influencias o patrocinio ilegal”, indicó el penalista, quien a su vez explicó que los funcionarios públicos tienen diversas responsabilidades –civiles, penales, administrativas y éticas–. “A partir de qué tipo de responsabilidad tiene ese funcionario público, se podrá establecer la sanción”, agregó.
 
En este sentido, Nakazaki señaló que, si el Fiscal Chávarry no cometió ningún delito, no puede ser sujeto de una denuncia constitucional, pues solo procede con respecto a los delitos de función. Asimismo, indicó que las infracciones constitucionales no pueden ser usadas en el Perú porque el Congreso aún no las tipifica. “Lo que se está haciendo con Pedro Chávarry en el Congreso no tiene sentido”, afirmó.
 
No obstante, el abogado explicó que una mentira, al constituir una falta ética o incluso una falta administrativa, puede tener otro tipo de remedio, que partiría de la renuncia u otro tipo de sanciones.
