Caso PPK: “Pesquisas del Congreso violan la prohibición de doble investigación por delito”

Nakazaki explicó que habeas corpus del expresidente Kuczynski no busca es sustraerlo de ninguna investigación.

El abogado César Nakazaki manifestó que el habeas corpus presentado por Pedro Pablo Kuczynki tiene por objeto que lo jueces constitucionales determines si, tratándose de la investigación de un delito, esta debe corresponder exclusivamente al Ministerio Público o puede ser una investigación compartida con el Congreso de la República.
 
En esa línea, el penalista indicó que la investigación que lleva adelante el Congreso viola la prohibición de doble investigación por delito. “Ya el Ministerio Público está investigando y estamos participando. Lo que sostenemos es que ahora los jueces constitucionales determinen finalmente si tenemos la razón o no en este planteamiento”, argumentó.
 
Asimismo, Nakazaki explicó que las comisiones investigadoras realizan pesquisas en temas de interés público, mas no investigan personas. “El Congreso tiene absoluta competencia para investigar delitos en el caso de procesos de antejuicio. En investigaciones parlamentarias no”, agregó.
 
Finalmente, el abogado señaló que el habeas copus interpuesto solo busca que las investigaciones se realicen por el cauce que establece la Constitución y el código procesal penal.
