Nakazaki comentó que se ha desnaturalizado el propósito de las investigaciones parlamentarias.

El abogado César Nakazaki explicó que el habeas corpus interpuesto a favor del expresidente Pedro Pablo Kuczynski busca que se respete su derecho a la prohibición de doble investigación de naturaleza penal, pues en eso se han convertido las investigaciones de las comisiones investigadoras del Congreso.
 
“Investigar si una persona ha cometido delitos para establecer como conclusión que ‘el expresidente es autor del delito de cohecho’, el Congreso no está facultado, en el procedimiento de investigación parlamentaria, para esa finalidad. La única posibilidad que tiene para investigar a una persona por la posible comisión de delitos, es en el antejuicio”, señalo.
 
En esa línea, Nakazaki sostuvo que, a través del habeas corpus, otro objetivo más amplio es el de luchar contra un defecto estructural del Congreso por el cual se han desnaturalizado las investigaciones parlamentarias.
 
Como ejemplo de esa desnaturalización, el penalista indicó que, a pesar de que han pasado decenas de testigos por la comisión Lava Jato, sus testimonios no servirán en la investigación penal, por lo que tendrán que repetirse. “Qué propósito tiene escuchar a un testigo que luego tiene que volver a declarar en el caso penal”, concluyó.
