El penalista César Nakazaki señaló que el testimonio de Jorge Barata, sobre los aportes entregados a Ollanta Humala y Nadine Heredia, tiene que ser comprobado para determinar si existió o no el soborno que se le imputa al exjefe de Estado. Agregó, que lo dicho por el exhombre fuerte de Odebrecht en el Perú en el proceso de investigación es un recurso del debido proceso, sin embargo, para que estas tengan valor legal tienen que ser dadas en juicio.
Asimismo, el penalista agregó que en caso de comprobarse la entrega de US$ 3 millones, sería el Partido Nacionalista el responsable por ser la persona jurídica. En ese sentido, indicó que ni el mismo Barata en su declaración no conocía el origen del dinero y es precisamente ese punto el que la justicia toma en cuenta para determinar la responsabilidad de los acusados
