El reconocido abogado, quien fue entrevistado por Mávila Huertas conductora del programa 2018, analizó el caso del expresidente Alan García.
Nakazaki manifiesta que hoy en día el concepto de persecución política se ha ampliado y permite la evaluación del estado que investiga a la persona para conocer si está en condiciones o no de garantizar un debido proceso.
"El principal problema que tiene el pedido de asilo político es demostrar que en el Perú no se garantiza un debido proceso por una serie de factores".
Por otro lado, el penalista comentó que existe un tema que Alan García tendría a su favor y es que el tratado prohíbe darles asilo a los procesados o inculpados y el expresidente García no es procesado.
“El impedimento de salida viene siendo una práctica que el Poder Judicial sigue dándolo equivocadamente, entiendo por necesidad, pero no porque tenga base legal”.
Manifestó también que un factor en contra, desde el punto de vista jurídico, es que el impedimento de salida toma por sorpresa al expresidente Alan García y su estrategia de solo acudir a las diligencias y que no pasara nada, se quiebra con el impedimento de salida, luego él reacciona hacia el futuro; los 100 mil dólares no son el problema, sino la operación estructurada y el origen del dinero.
