Caso Keiko Fujimori: “No hay una sola explicación para que 20 personas hayan sido detenidas”

Nakazaki agregó que es muy probable que más adelante se dicte una prisión preventiva.

El abogado César Nakazaki explicó que la medida de detención preliminar solo debe aplicarse en casos en los que haya investigaciones o diligencias pendientes para las cuales sea necesario que el investigado esté detenido. En este sentido, apuntó que este no es el caso de Keiko Fujimori y las 19 personas detenidas junto a ella como parte del proceso que se le sigue por el caso cócteles.
 
“En una investigación preliminar que tiene casi 3 años, que tiene centenares de diligencias, no hay una sola explicación para que 20 personas tengan que ser detenidas cuando lo que correspondía era, si el fiscal tiene un caso armado, pasar a un proceso penal y ahí discutir un requerimiento de prisión si así corresponde”, sostuvo el penalista.
 
Asimismo, el abogado indicó que existe una gran probabilidad de que, tras los 10 días de detención preliminar, se abra un proceso penal contra los involucrados, se formalice la investigación preparatoria y se dicte una prisión preventiva.
 
Finalmente, Nakazaki señaló que el Tribunal Constitucional ya había criticado la metodología que utiliza el juez Richard Concepción Carhuancho para privar la libertad de los investigados, calificándola de inconstitucional y exhortándolo a corregir su método. “Si no la corrige, no me cabe duda que la sala que lleva este caso la va a corregir”, sentenció el letrado.
