Caso Humala: “Recusamos al autor de una detención arbitraria; el fiscal recusa a quien nos da la razón”

Para Nakazaki, la Fiscalía se sentiría cómoda con el juez Concepción “porque normalmente les da la razón”.

Respecto a la recusación que planteó que fiscal Vela, el abogado César Nakazaki comentó que al fiscal no le ha gustado que el Tribunal Constitucional resuelva a favor de la defensa de Ollanta Humala y Nadine Heredia respecto a la recusación que presentaron por la prisión preventiva arbitraria que cumplieron.
 
“Nosotros recusamos porque el TC estableció que 4 jueces fueron autores de una prisión preventiva inconstitucional. Al fiscal no le gusta que se resuelva a favor de la defensa y planteó su recusación, y ahora nosotros tenemos que seguir en la misma línea”, manifestó el penalista en entrevista para Canal N.
 
De acuerdo a Nakazaki, la diferencia en el uso de estas medidas radica en que la defensa del matrimonio Humala-Heredia planteó una recusación contra los autores de una detención arbitraria, mientras que el fiscal solo busca recusar a quienes le hayan dado la razón a la defensa.
 
“Para el fiscal Vela ningún juez nos puede dar la razón y ello no se da porque a alguien le gusta o no le gusta una persona, sino a quien tiene el derecho a su favor. Hay autores de detenciones arbitrarias y ellos ya no pueden participar en un proceso. Esa es nuestra posición”, sentenció.
