En entrevista para Cuarto Poder, el abogado César Nakazaki manifestó que no existe ninguna formalidad que impida acabar con una detención arbitraria como la de Ollanta Humala y Nadine Heredia
El abogado César Nakazaki explicó que no es obligatoria la presencia del juez Eloy Espinoza, para que el Tribunal Constitucional tome una decisión con respecto al habeas corpus presentado por Ollanta Humala y Nadine Heredia para lograr su libertad ante una prisión preventiva abusiva y arbitraria.
En este sentido, aseguró que, a pesar de que el presidente del TC cuenta con la facultad de voto doble y que incluso el juez Espinoza-Saldaña ya habría dejado su voto por escrito, el caso no se habría resuelto aún porque se le quiere dar mayor legitimidad, esperando que todos los miembros estén presentes.
No obstante, el penalista indicó que no existen formalidades que impidan acabar con el abuso de una detención arbitraria y espera que el TC tome su decisión en un corto plazo y dé por terminada la prisión preventiva de la expareja presidencial.
