El penalista César Nakazaki indicó que las bases jurídicas de las diligencias que se realizan en Brasil generan suspicacias porque son acuerdos firmados entre la Fiscalía y la Procuraduría de ese país que no se conocen. Nakazaki señaló que las declaraciones de Marcelo Odebrecht y Jorge Barata son parte de procesos peruanos que se dan en Brasil porque ambos testigos viven allá, pero que son exclusivos del procedimiento penal peruano que se rige por las leyes que emite el Congreso del Perú.
Asimismo, señaló que si los acuerdos que se firmaron en Brasil, que les otorga inmunidad o beneficios económicos, han sido solo para que declaren allá y no en el juicio peruano, entonces sus testimonios no tendrán ningún valor y los beneficios habrían sido en vano. Además, agregó que ha exigido la presencia de Carlos Kauffman, abogado de Barata, para discutir las diligencias del proceso penal de Ollanta Humala y Nadine Heredia porque es vital que los testimonios brindados en el caso tengan valor legal.
