Nakazaki nos invita a participar de esta charla y reflexionar respecto a un tema que durante las últimas semanas ha cobrado especial interés: la prisión preventiva. Junto a él participan dos grandes exponentes de la nueva corriente sobre la técnica de litigación oral: Dr. Benji Espinoza y Dr. Jefferson Moreno.
El penalista manifestó que luego del juicio de Alberto Fujimori, el caso que más se ha sido televisado es esta audiencia de prisión preventiva, donde todos han podido observar a favor o en contra, los gravísimos efectos que genera este mecanismo.
“Dicen que para medir la libertad en una sociedad hay dos termómetros: la prisión preventiva y el Hábeas Corpus, si funcionan ambos, una sociedad puede estar tranquila porque se respeta la libertad pero si falla el Hábeas Corpus y si se abusa de la prisión preventiva, entonces la libertad en una sociedad no se respeta”.
Nakazaki señaló además que “El proceso penal no se ha creado como una llave para abrir la cárcel, sino como un mecanismo de garantía de la libertad, donde solo el culpable debe ir a la cárcel y excepcionalmente un hombre que debe presumirse inocente”.
Finalmente, indicó que lo importante es reflexionar que le hacemos justicia a los seres humanos y si hacemos justicia a los seres humanos, ¿Qué podemos hacer y qué no podemos hacer con un ser humano?.
