Para César Nakazaki, el indulto otorgado al expresidente Alberto Fujimori se enfrenta a dos grandes problemas que son la revisión de sentencia de la Corte IDH y la decisión de la Sala Nacional sobre si respeta o no la gracia presidencial. Al respecto, el penalista indicó que el tribunal supranacional podría dictar que la libertad de Fujimori rompe las normas del Pacto de San José en materia de derechos humanos y solicitar su anulación, pero que cualquier defecto administrativo que se encuentre puede ser subsanado sin que el exmandatario regrese a prisión.
Además, sostuvo que en el caso de la Sala Nacional, el código de procedimientos penales de 1940 que rige el caso Pativilca, señala que el enfermo solo puede ser procesado si tiene capacidad física para que enfrente el juicio y que en el caso de Fujimori, la fibrilación auricular que padece permite establecer la incapacidad para ser juzgado. Por lo tanto, agregó que la libertad del expresidente, a pesar de resultados negativos, puede ser protegida usando las herramientas jurídicas adecuadas.
