Audios CNM: “Los audios deben ser parte de las investigaciones para establecer conclusiones”

Nakazaki indicó que nadie es inocente o culpable a partir de un audio, sino que se deben realizar las investigaciones y proceso adecuado.

Debido a la importancia de los llamados audios de la vergüenza para dar solución a la crisis en el sistema judicial, el abogado César Nakazaki comentó que estos deben superar la prohibición de la prueba ilícita, de modo que puedan formar parte de las investigaciones para determinar si existen faltas o delitos y las sanciones que conllevan.
 
“En la primera defensa que hice en el caso del excongresista Luis Alberto Emilio Kouri Bumachar, señalé que no iba a cuestionar los Vladivideos por la importancia que tenían para la salud moral del país. […] Creo que esa es la misma línea con la que se debe trabajar con los audios de la vergüenza y que, por tanto, en su momento serán pruebas”, sostuvo el penalista.
 
Nakazaki señaló también que actualmente los audios no sirven para absolver ni condenar a nadie, sin embargo, deben ser el “punto de partida de una investigación que debe realizarse con seriedad y celeridad” y que debe establecer si existe un delito, una falta administrativa grave o una conducta antiética.
